Acceptance of the Terms of Use
The following Terms of Use set out the legal terms and conditions on which Vaud Promotion (hereinafter: “We”), based at Avenue d’Ouchy 60 in 1001 Lausanne (Switzerland) and who can be reached by the email address vaud-a-la-carte@region-du-leman.ch, allows you to get and use a “Vaud à la carte” prepaid card. By using a card, you acknowledge that you have read and understood these Terms of Use and agree to be bound by them.
Vaud Promotion may change these Terms of Use at any time.OPERATION
The prepaid card “Vaud à la carte” may be used only during the period of validity mentioned on the card and/or found by scanning the QR code on the card. It may be used as a means of payment directly at tourist service providers. A list of those providers is available on the website http://www.myvaud.ch/providers, i.e. restaurant, museum, tourist site, winery, tourist transport or hotel.
It may be used by the client to pay in whole or in part their bill, with one or more providers, once or several times, within the limit of the available balance.
The client is in no case entitled to resell nor claim for reimbursement of the balance of the card.Limitation of Liability
To the maximum extent possible by law, Vaud Promotion excludes all and any warranty, guaranty and responsibility in relation to the “Vaud à la carte” prepaid card or the Platform.
Vaud Promotion has signed a collaboration agreement with the company Boncard, which provides the service and management system for prepaid cards "Vaud à la carte". Boncard makes every effort to allow a trouble-free and uninterrupted use of the service but cannot guarantee this at all times. It reserves in particular the right to suspend the access to the service at any time in the event of a high security risks or malfunctioning as well as for maintenance work and to temporarily suspend the system in the event of force majeure event or technical failure.
No claim for damages may result from technical failures which exclude or hinder the use of the “Vaud à la carte” prepaid card. Vaud Promotion does not warrant that the Platform shall be available at all times and expressly reserves the possibility to discontinue the Platform at any time without notice.
Vaud Promotion is in no case responsible for the services provided bay the providers as part of the use of the “Vaud à la carte” card. Only the provider is responsible and its own conditions apply to the relationship between itself and the client.Governing Law and Jurisdiction
These Terms of Use are governed by Swiss law.
Any dispute regarding these Terms of Use, their existence, validity, interpretation, execution or non-execution, shall be subject to the exclusive jurisdiction of the competent ordinary courts in Lausanne (Switzerland).
